"Gated & Guarded" in Parliament

tigermania's picture

Dear All,
This is from YB Theresa Kok's blog. Please note that we are not a stratified titled property but residential property with individual titles.
Please note the answer from Ministry of Housing & Local Government:
"With this amendment, the Resident’s Committee or the Management Body is recognised from a legal aspect to build fences and road barricades in the area of the scheme concerned. This is because issues such as the road and open land are jointly owned properties under the administration of the management body for a particular gated community scheme."
In Puchong Hartamas, the only thing we own are our own houses. The roads and common area are under MPSJ after being handed over by the developer to the Ministry of Land (I think).
Regards.

Pertanyaan: Lisan
Daripada: YB Puan Teresa Kok Suh Sim (Seputeh)
Tarikh: 2 November 2009 (Isnin)

Question: Aural
From: YB Puan Teresa Kok Suh Sim (Seputeh)
Date: 2 November 2009 (Isnin)
Question: YB Puan Teresa Kok Suh Sim (Seputeh) asks the Minister for Housing and Local Government to state whether the Ministry will amend the  Street, Drainage and Building Act 1974 to facilitate the building of security huts in residential areas and allow more residential areas to be converted into gated communities.
Answer:
Tuan Yang DiPertua,
For the information of Yang Berhormat, the allowance which permits the setting up of a gated community falls under the Strata Titles Act 1984 and  Uniform Building By-Law 1984.
The amendment to the Strata Titles Act 1985 which came into force on 12 April 2007 had added a particular allowance which permits the setting up of gated communities. With this amendment, the Resident’s Committee or the Management Body is recognised from a legal aspect to build fences and road barricades in the area of the scheme concerned. This is because issues such as the road and open land are jointly owned properties under the administration of the management body for a particular gated community scheme.
In relation to that, the Ministry of Housing and Local Government at this time has no intention to amend the Street, Drainage and Building Act 1974 to develop gated communities in view of the fact that other existing laws are found to be adequate.

We are not a stratified titled property and the land outside our house belongs to the state government.

That's why the PHRA should not charge residents for the red stickers, even if more than two are required. The residents live here and have the right to move in and out unimpeded and without conditions, unless it's a security issue. The red stickers are meant to help the security guards to identify cars belonging to residents and that is the rationale for the security company to issue the stickers. When we are asked to pay for the additional stickers, we are asked to pay to help the security company in their work in addition to the monthly security charges! If the PHRA had incurred a cost in printing the stickers, only the cost should be charged. It is NOT the money, which is not a significant sum, but the charge is not the right thing to do.

If the PHRA needs to raise funds, it should think of other ways. By charging residents with more than two cars, the additional charge has become a selective one.

Residents with cars had earlier paid for electronic cards, RM50 per piece, issued by the developer. Did the PHRA look into this issue when negotiations were conducted with the developer? Is a refund being arranged? After all we had paid for these electronic cards in the belief that they would be used for years without any change oe interruption. The red stickers should be exchanged in future for new ones without any additional charge when there is a need for new ones.
